A Beginner’s Guide to Consumer Debt Relief

The Lawyers at McCarthy Law Can Help You Get Out of Consumer Debt Without Bankruptcy

If you are in need of consumer debt relief you are not alone. With tough financial times and credit card companies freely handing out credit, many Americans are finding themselves deeper in debt. Whether you are facing a financial emergency or your finances have simply got away from you, the lawyers at McCarthy law are here to help and we’re ready to get you back on your feet. We negotiate large reductions in consumer debt without the need for bankruptcy.

The First Step in Getting Consumer Debt Relief

Before talking to an attorney, there are several things you can do to make the process go smoother. First, look at your financial situation and develop a realistic budget. Analyze how much money you take in and how much you spend by listing all your sources of income and all your expenses, even minor ones. In particular, be sure to write down all of your debts, whether they be credit cards, auto loans, payday loans, medical debt, mortgage debt, etc.

How We Can Help

One of our attorneys will sit down with you and perform a debt analysis in a free consultation. We will then determine how much you can realistically afford to pay and put together a plan for reaching a settlement on all of your consumer debts. Once retained, we will then begin the negotiation process to settle your debts for a fraction of the amount your creditors want. Because we have helped numerous people just like you, and dealt with most of the major creditors, our clients get results.

Stopping the Harassing Calls

The Fair Debt Collection Practices Act is a federal law that forbids debt collectors from engaging in abusive behavior. This law prohibits collectors from calling between 9 p.m. and 8 a.m. Collection agents cannot lie to you, tell you that you owe more than you actually do, or talk about your debt with anyone other than you, your spouse, or your lawyer. Debt collectors cannot repeatedly or continuously call with the intent to annoy, abuse, or harass you. If you give the collection agency a written request to stop further contact, the agency must honor the request and cannot contact you in any way other than litigation.

Our lawyers are familiar with these laws and will make sure your rights are respected and protected. Once retained, we will contact all of your creditors and instruct them to direct all communications to us so you stop receiving the harassing calls.

Beware of Scams

Many debt relief companies offer enticing advertisements and tempting promises such as a guaranteed lower interest rate or lower credit card payment. But, some of these companies are simply too good to be true. A growing number of companies are running scams preying on consumers struggling with debt by making impossible promises, collecting non-refundable fees from the trusting consumers, and then later telling the consumers that they were unsuccessful in negotiating with creditors.

Even well meaning companies may leave you disappointed. Debt relief companies often do not offer licensed attorneys and creditors are less likely to negotiate with them. Instead of struggling with a debt company, trust the attorneys at McCarthy Law to advocate for you as they negotiate with your creditors for a large reduction in your debt. Our attorneys are familiar with the local laws and can be sure that your rights are being protected. If you are facing consumer debt, don’t wait to take action.

Give us a call and we will work with you to get you out of debt. We offer a free consultation with a consumer debt lawyer.
